Terms of Use for Our Chapters

These Terms of Use ("Terms") are app-specific terms for the Our Chapters iOS app (the "App") provided by Taylor Sanson ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms.
These Terms supplement, and do not replace, Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA") for apps distributed through the App Store. If these Terms conflict with the Apple Standard EULA about the scope of your App Store license, the Apple Standard EULA controls.

2. The App
Our Chapters is a personal and family memory app for parents, guardians, and other adults. It helps you save memories, photos, child profiles, and prompts, and it can support optional shared-family spaces.
The App is intended for adults. It is not directed to children under 13, and children under 13 should not use the App directly.
3. License
The App is licensed, not sold. For App Store distribution, your license to use the App is governed by the Apple Standard EULA:

These Terms add app-specific rules for Our Chapters, including rules about your content, family sharing, Premium, support, and disputes.
4. Your Content
You keep ownership of the memories, photos, child profiles, family information, prompt responses, and other content you add to the App ("User Content").
You are responsible for making sure you have the right to add, store, and share your User Content, especially when it includes information about children or other people. If you add information about a child or another person, you represent that you have the authority or permission needed to do so.
5. iCloud Sync and Family Sharing
The App relies on Apple's iCloud and CloudKit services for app data sync. App data syncs using your personal Apple account. If iCloud, CloudKit, your Apple account, device storage, or network access is unavailable, sync and sharing may be delayed, limited, or unavailable.
Family sharing inside Our Chapters is optional. If you create or join a shared family, shared memories and shared-family content sync through Apple CloudKit sharing and become available to the people invited to or participating in that shared family. Please share only content you are comfortable making available to those participants.
The App's shared-family feature is separate from Apple's App Store Family Sharing for subscriptions unless the App Store product page or Apple purchase flow says otherwise.
6. Not a Backup Service
Our Chapters is not a backup, archival, or disaster-recovery service. Because the App may hold emotionally important memories and photos, you should keep independent copies of anything you cannot afford to lose.
We do not guarantee that content will always be available, recoverable, or free from sync conflicts, deletion mistakes, device loss, iCloud issues, software bugs, or Apple service interruptions.
7. Premium Subscription
The App offers Premium through Apple's in-app purchase system as an auto-renewable monthly subscription. Premium currently unlocks Family Sharing and Memory Prompts.
The subscription is part of the Our Chapters Premium subscription group and is currently offered as "Premium Monthly." The price shown in the App Store purchase flow before purchase controls and may vary by country, currency, taxes, promotions, and Apple pricing rules.
Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically unless canceled at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the end of the current billing period.
You can manage or cancel your subscription in your Apple account settings. If you previously purchased Premium, you can use the App's restore purchases feature where available.
We do not receive your full payment card number and do not control Apple's billing systems. Refund requests for App Store purchases are generally handled by Apple under Apple's refund policies, unless applicable law requires otherwise.
8. Acceptable Use
You may use the App only in compliance with applicable law. You agree not to use the App to violate another person's rights, add or share content you do not have the right to use, harass or endanger another person, disrupt the App, bypass Premium gating or security features, or misuse the App except where a restriction is prohibited by law.

10. Apple and Third-Party Services
The App relies on Apple services and frameworks, including iCloud, CloudKit, StoreKit, and notification features. Your use of Apple services may also be governed by Apple's terms, conditions, and privacy practices.
11. Availability, Changes, and Disclaimer
The App and its features are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee that the App will always be uninterrupted, error-free, secure, or available.
We may update, improve, modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice where appropriate.
12. Limitation of Liability
To the fullest extent permitted by law, Taylor Sanson will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, memories, photos, profits, goodwill, or business interruption arising out of or related to your use of the App.
If the foregoing limitation is not fully enforceable, our maximum liability to you for any claim arising out of or relating to the App will be limited to the amount you paid for the App or Premium during the 12 months before the event giving rise to the claim, or USD $50, whichever is greater.
Some jurisdictions do not allow certain warranty disclaimers or liability limits, so some of the above may not apply to you.
13. Contact Before Formal Claims
Most concerns can be resolved informally. Before either of us files a formal legal claim relating to the App, we agree to first contact the other side, describe the issue, and try in good faith to resolve it informally for at least 30 days.
You can contact us at the support email listed above. This informal process does not prevent either side from seeking urgent relief where necessary or from preserving a legal claim before a deadline expires.
14. Governing Law
These supplemental Terms are governed by the laws of the Commonwealth of Massachusetts, United States, excluding its conflict-of-laws rules, unless applicable consumer-protection law requires otherwise. The Apple Standard EULA and your relationship with Apple may be governed by separate Apple terms.
15. Termination
You may stop using the App at any time. You may also cancel your subscription through Apple if applicable.
We may suspend or terminate your access to the App if you violate these Terms or if we need to do so for legal, security, or operational reasons. Sections that by their nature should survive termination will survive.
